McConnell's legal office releases January, February Article 15s Published March 7, 2011 By Legal staff 22nd Air Refueling Wing Judge Advocate MCCONNELL AIR FORCE BASE, Kan. -- Below is a list of prohibited actions committed by Airmen, who received Article 15s, as well as additional punishments. DUIs: Two McConnell members were caught driving under the influence in January. Zero McConnell members received a DUI in February. One member has pending non judicial punishment and the other received reduction to the grade of Airman Basic, 15 days extra duty, 30 days restriction and a reprimand. ARTICLE 15s: A staff sergeant from the 344th Air Refueling Squadron received a suspended reduction to the grade of airman first class and a reprimand for disrespecting a superior NCO and for Failure to Go. A senior airman from the 22nd Aircraft Maintenance Squadron received a reduction to the grade of airman first class, a suspended reduction to the grade of airman, and a reprimand for wrongful possession and use of marijuana. He was later discharged for his drug abuse. A senior airman from the 22nd AMXS received a reduction to the grade of airman first class, 15 days extra duty and a reprimand for Failure to Go. A senior airman from the 22nd Civil Engineer Squadron received a suspended reduction to the grade of airman first class, forfeiture of $961 pay for two months and a reprimand for Dereliction of Duty. The member negligently discharged a firearm on base and wrongfully carried unregistered concealed weapons onto the installation. An airman first class from the 344th ARS received a suspended reduction to the grade of airman, forfeiture of $62 pay for two months, 15 days restriction to base and a reprimand for Failure to Go and Making a False Official Statement. An airman first class from the 22nd AMXS received a suspended reduction to the grade of airman, 45 days restriction to base and a reprimand for Dereliction of Duty. The member was caught sleeping on duty. An airman first class from 22nd AMXS received a reduction to the grade of airman basic, 30 days restriction to base and a reprimand for two separate but consecutive DUIs. An airman from the 22nd CES received a reduction to the grade of airman basic, 15 days of extra duty, 30 days restriction to base and a reprimand for Dereliction of Duty and DUI. An airman from 22nd Maintenance Squadron received a suspended reduction to the grade of airman basic, 30 days of extra duty and a reprimand for Dereliction of Duty. The member failed multiple dorm room inspections. DEMOTIONS: A staff sergeant from the 22nd Communications Squadron was demoted to senior airman for failure to meet Air Force Fitness Standards. DISCHARGES: A staff sergeant from the 22nd Logistic Readiness Squadron went to an administrative discharge board on Feb. 18, 2011 for failure to meet Air Force fitness standards. The board recommended separation with an Honorable Discharge and the opportunity for probation and rehabilitation. A senior airman from the 22nd MXS went to an administrative discharge board on Jan. 26, 2011 for wrongful use of marijuana. The board recommended separation with an Honorable Discharge. An airman first class from the 22nd CES was administratively discharged on Feb. 15, 2011 for a personality disorder. COURTS-MARTIAL: Airman William Ewing was court-martialed before a General Court-Martial on Jan. 4, 2011. He was charged with aggravated assault of a child and child endangerment. He was found guilty of assault consummated by battery of a child and child endangerment. He was sentenced to three years confinement, total forfeitures and a Dishonorable Discharge. Tech. Sgt. David Gutierrez was court-martialed before a General Court-Martial on Jan. 18, 2011. He was charged with multiple accounts of aggravated assault, adultery and indecent acts. He was found guilty of all but one of the charges, receiving a punishment of eight years confinement, reduction to E-1, total forfeitures and a Dishonorable Discharge.
